The issue of seniority has always worried working people. After all, time is an irreplaceable resource, and the future directly depends on what it will be spent on. Thinking about the upcoming pension, the employee, first of all, tries to take into account his seniority, on which the time of occurrence and the amount of future pension payments will depend. Do the precious months and years devoted to training correlate with the calculation of seniority, and how exactly? Let's consider in more detail.

What are the internships

Seniority- this is the period of time when a person was employed or engaged in socially useful activities defined by law. A document confirming the length of service of a person is usually a work book. If it is lost, certificates of salary accrual to the employee can play the role of proof of official employment.

Before the reform of 2002, the concept of " general work experience» - the sum of all periods of work activities referred to in legislative acts, excluding breaks. At that time, such periods also included full-time study at a university or special educational institutions. A record was made in the labor record about the period of study.

Since the beginning of 2002, the new Federal Law “On labor pensions in the Russian Federation” has replaced the general labor pension with the term “ insurance experience". From the definition itself, the main feature is clear, according to which the activity is suitable for seniority: it is necessary that during the employment of a person legal contributions to the Pension Fund (in Soviet times - contributions to state insurance) should be made.

IMPORTANT INFORMATION! It is not taken into account whether there were breaks between employment: "continuous experience" has been abolished.

Sometimes in special documentation there may be other concepts of experience that affect the calculation of various accruals:

  • public service experience- work in government organizations;
  • continuous experience- a concept that was liquidated on 01/01/2007. It is not taken into account when calculating accruals for pensions and sick leave. It may turn out to be significant only when compared with the insurance experience after a year of reform (if the continuous experience exceeds the insurance one, the pension will be calculated based on the continuous one);
  • special insurance experience- work that gives the right to the citizens employed in it for early retirement.

Studentship and experience

The years that a person devotes to learning a chosen profession, studying at a college, college, university, are rather long time periods related to future employment, directly or indirectly. Will they be covered by insurance? We reason logically and do not contradict the law.

The time of study in any educational institution is not mentioned in Art. 12 of the Federal Law No. 400 “On insurance pensions” dated 01.01.2015. A student does not make pension contributions, and this is the main argument for a negative answer.

NOTE! If a student worked before the start of studies and he has a work book, the insurance record will include work time, but not study time. When, after graduating from an educational institution, he finds a job, the experience will grow, because breaks are not taken into account in it.

The only exception

The law will include studies at a university in the insurance period only in two cases:

  • an educational institution subordinate to the Ministry of Defense of Russia;
  • the university trains future law enforcement officers (Ministry of Internal Affairs department).

Students of these universities are equated to military conscripts, and this activity, as Article 10 of the Federal Law “On Pensions in the Russian Federation” says, is included in the length of service.

If the employee studied during the Soviet era

For a large number of people preparing to receive a pension, the time of study ended before 1991, when the concept of total work experience was in effect, which also included stay in educational institutions.

However, Art. 10 of the Federal Law of December 17, 2001 excludes this time from the length of service, even if a pension was accrued to such a citizen even before the reform.

Part-time work while studying

A student in the learning process can officially find a job:

  • by concluding an employment contract for a “conscript” (for example, during vacation months);
  • performing home work under an employment contract;
  • by choosing a formalized remote collaboration.

Since, while working, he will also make pension contributions, respectively, these periods will go to his length of service.

The student has the right to start saving for retirement

According to the laws of the Russian Federation, having received a passport at the age of 14, a student can officially find a job. Working at such a young age, a citizen of the Russian Federation is already accumulating funds on his account for a future pension, increasing his insurance experience.

Studying while working - but what about experience?

It is not uncommon for working citizens to receive in-service training. Naturally, a question arises among employees who are studying: how does the time spent on study correlate with work experience, because at this time they do not work?

Art. 173 of the Labor Code of the Russian Federation guarantees employees sent for training by the employer or who entered independently, additional study holidays, for which payment continues to be made in the amount of average earnings. When else, while studying, you can not lose experience?

In the life of employees, there are moments of different duration when they do not actually fulfill their labor function, but the experience is not interrupted. Naturally, the experience will continue to increase if a person is also studying during such a special period. By law, the insurance period continues to go if the employee is busy:

  • military service or cooperation with the Ministry of Internal Affairs;
  • improvement of health (with an official certificate of incapacity for work);
  • your baby up to 1.5 years of age;
  • looking after a disabled person of the 1st group (including a child), an elderly relative (after 80 years);
  • being on the road for employment in another area, if the referral is received from the employment service;
  • public works;
  • departure of the conclusion;
  • evidence of the groundlessness of bringing to criminal responsibility.

IMPORTANT! The listed periods are included in the insurance period if before these events or immediately after them the person was employed and deducted PFR contributions.

The period of study will be included in the length of service if, at the same time as studying, a person was officially employed and made deductions from his salary to the FIU. The only exception is education in subordinate educational institutions.

How much a person will receive a pension depends on how much service he has been accrued. Therefore, this period is given great attention.

In order to receive a decent payment in the future, a person must officially work and transfer a certain amount to the PFR account. Let us analyze the situations when the years of study are included in the length of service.

At the technical school

Work experience also includes the process of preparing for a profession. But the answer to the question of whether the period of study at a technical school is counted in the length of service can be answered in the negative.

At university and institute

There are some exceptions to the rules in which education in a higher education institution
included in the work experience. This applies to such situations:

  1. If the student is studying full-time e, but at the same time officially works at any enterprise.
  2. The person already worked officially, and after that he entered the university. But in this case, there should be a corresponding entry in the work book.
  3. No formal employment, and never was, but every month a person makes a voluntary contribution to the account of the Pension Fund.

Only an internship can be included in the experience. Although this is a form of education, a person works in his specialty. Doctors-interns are officially employed, work and receive payment for their work, and also pay contributions to the Pension Fund. These systems pay for education in specialized institutions, so study is equated with work.

If there are conditions for accrual of experience for study, then this must be confirmed with the help of special documents. But, these rules have long been canceled. Therefore, the Pension Fund refuses to take into account the time of study when calculating a pension for those teachers who draw it up after the Regulations ceased, that is, after October 1, 1993.

According to the current pension legislation, the experts answer the question “whether study at the institute is included in the total work experience” in the negative. Years of study are not included in the labor or insurance experience.

Seniority in pension legislation is a very delicate matter. It is perhaps difficult to find anywhere else as many nuances as in the rules for calculating seniority for a pension.

One of the most "sick" topics here has always been and remains inclusion in the study experience. Let us consider how now, following the results of several pension reforms, the issue of including various periods of study in the length of service is being resolved.

It should be borne in mind that seniority in pension legislation is understood in several meanings:

1) the length of service that gives the right to the appointment of an insurance pension (insurance experience),

2) the length of service that is relevant for calculating the pension (total length of service before January 1, 2002),

3) the length of service that gives the right to an early appointment of a pension (the so-called preferential or special insurance experience).

Accordingly, the issue of including studies in the length of service is solved in different ways, depending on what kind of experience is meant.

Within the framework of this article, the issue of including studies in the total length of service (i.e., in the insurance period for assigning a pension and the total length of service for calculating a pension) is disclosed.

The rules for including studies in preferential service will be set out in the next article.

1. When is study included in the length of service for the appointment of a pension?

As of 2018, at least 9 years of insurance experience is required to assign an old-age insurance pension, and at least one day of experience for disability or loss of a breadwinner.

From January 1, 2002, when the Federal Law “On labor pensions in the Russian Federation” came into force, studies were no longer included in the length of service for granting a pension. From this date, the experience includes only periods of work for which insurance premiums were transferred to the Pension Fund, and a number of other periods expressly specified in the law (care for a disabled person, for a child, etc. - “non-insurance periods”). Therefore, periods of study that took place after January 1, 2002, will not be included in the required 9-year service for old-age pension, and it is useless even to sue on this issue.

If you have periods of study before January 1, 2002, then you can apply for their inclusion in the length of service for the appointment of a pension. At the same time, studies in vocational and secondary specialized educational institutions are included unconditionally, but studies in institutions of higher education are included on the condition:
